Generally Accepted Accounting Principles Essay

A person will be said to be guilty of the offence if he dishonestly appropriates himself or herself, property belonging to another person, with a clear intention to deprive permanently the other of it. For purposes of legal interpretation, theft and stealing shall be construed accordingly to mean the same thing. Where, stealing can take the place of theft and theft can be said to be stealing. In order to be said that theft has occurred, the thief, according to subsection 2, will appropriate himself with a view to gain or otherwise for his own benefit. The owner of the property then, shall in this case, suffer the loss of enjoying the benefits of the property in which the thief has appropriated himself. The supplementary definitions of terms arising from the definition of theft have been substantially dealt with thereafter from section 2 to 6 (Hooper & Ormerod, 2011). There have been some changes to the act over the years, the latest being as late as 2006. The changes are carried in two major changes (repeals); the Theft Act 1978 and the Fraud Act 2006. Maxwell and Boltzmann presented the distribution in kinetic energies for two temperatures (high and low) in graphs called distribution curves on which the areas under the curves past the points called energy barriers represent the number of kinetic energies. There may be many mistakes in counting the number of bubbles produced for five continuous minutes and so the experiment would not be accurate. Although this experiment isnt so accurate, I think that the results will still show a trend in the pattern of results. I predict that if the concentration of the HCl is doubled then the experiment will happen twice as fast. HYPOTHESIS FOR EXPERIMENT 2 COLLECTING GAS OVER WATER By putting more particles into the reaction, the chance of them colliding increases and so the rate increases. Concentration is a variable that is continuous and independent. I shall test this variable by observing the rate at which hydrogen gas collects over water against the concentration of hydrochloric acid used with CaCO3. I predict that by doubling the concentration of the acid, the rate of reaction will also double. The higher the concentration, the higher the rate of reaction. HYPOTHESIS FOR EXPERIMENT 3 COLLECTING GAS IN A SYRINGE This experiment is very similar to experiment 2 (collecting gas over water) but this experiment is the most accurate out of the three that I will be carrying out. I predict that I will have a very similar type of results and graphs as in experiment 2. I predict that the graph will have more better and accurate trend lines in the graphs showing a curved line of best fit. The higher you raise the concentration the more the particles will collide therefore corrosion of the marble will occur. Plan for the investigation. I will ensure that the goggles are worn throughout the experiments. Care will be taken not to spill any of the acid. Glass will be handled with care to prevent breakages and cuts. If any sort of accident occurs amends will be made with the help of trained technicians. Large volumes of acid will not be carried around to reduce the risk of a spillage. Containers will be kept well away from edges of the benches. Low molar concentration of hydrochloric acid will be used for safety. FAIR TEST To perform a fair test I will do as follows: In the experiment I will measure each substance accurately. I will carry out the experiment at the same room temperature of 20oc each time. I will wash the conical flask with distilled water after each experiment to make sure that there isnt any solution left over from the previous experiment. I will have to stay alert when counting bubbles and will have to concentrate hard. I will also repeat the test again and take the average of the two results to get an average set of results which will be more reliable. By following my fair testing the results will hopefully come out accurate. I will be alert and take the timings accurately for each of the experiments. METHOD FOR EXPERIMENT 1 COUNTING BUBBLES. This is how I will be carrying out my 1st experiment to find out the rate of reaction between marble and hydrochloric acid: When doing my experiments I will use the same procedure throughout. I will first get the necessary equipment that will be needed and will set it up as show below. I will then get 30ml of 0. 1M hydrochloric acid and will put it into the conical flask. To make sure the volumes of acid and water were right we will measure the volumes of each in a measuring cylinder to be accurate. To make sure the mass of marble chips are right we would measure them on the electronic balance to one decimal place. I will then get 2grams of marble chips (roughly the same size) and I will gently put the marble chips into the solution of hydrochloric acid and will spontaneously close the conical flask with the delivery tube that is attached to a bung at the end. As soon as I close the top of the flask, I will start the stopwatch and I will start counting the bubbles, which will be coming out from the test tube. I will record the number of bubbles produced each minute up to five minutes. The bubbles that will be produced will indicate how much CO2 is being given off by the reaction between CaCO3 and 2HCl. I will carry out this experiment again for Distilled water, 0. 5, 1. 0, 1. 5 and 2 molar to see how the concentration affect the rate of reaction. I will keep the amount of marble chips and hydrochloric acid the same for every test I carry out so it would be fair. At the end I will also carry out this experiment on distilled water so I can compare the two substances. In this experiment I will have to concentrate all the time as I will have to count the bubble for five minutes and will have to make sure that I dont miss out on counting a single bubble. After the experiment is over, I will carry out the experiment again to confirm my results and to make sure that I was counting the bubbles correctly. METHOD FOR EXPERIMENT 2 COLLECTING MEASURING GAS This is how I will be carrying out my 2nd experiment to find out the rate of reaction between marble and hydrochloric acid: When doing my experiments I will use the same procedure throughout. I will first fill the tub with tap water about half way up and fill the measuring cylinder with water and then turn the measuring cylinder upside down into the tub of water so the cylinder would still be filled with water. By doing this, we will create a slight margin of error because some of the water will be displaced when doing this although it will be very little. Then we will clamp the measuring cylinder in place. We will change the size of the cylinders; however, this will not make the test unfair. We then will put the delivery tube under the cylinder so the air from the experiment could displace the water. To make sure the volumes of acid and water were right we will measure the volumes of each in a measuring cylinder to be accurate. I will then get 30ml of 0. 1M Hydrochloric acid and put it into the conical flask. To make sure the mass of marble chips are right we would measure them on the electronic balance to one decimal place. As soon as we put the Marble chips and the acid in the conical flask and close it with the bung which will be attached to a delivery tube; we will immediately start the stopwatch. Their one of the main objectives is to improve the sustainability and environmental performance of construction. Thus it need a well organized preplan and to maintain it; that means project management. Now the question come that, does it really important to maintain a project management in the built environment specifically in the UK construction industry.  · Background: There is no doubt that the construction industries in built environment today face more challenges than in the past. The modern business environment is operating in a highly turbulent time. Demand for operational activities to achieve effectiveness and efficiency, the environment has increased the need for organizational accountability both in public and private sector. The UK construction industry is a growing sector and developing day by day. In this case project management is viewed as a tool that helps the organization to carry out selected project effectively and efficiently. This project management tool in the built environment does not guarantee the project success. It has been seen that some project completed within the determined time and meet all requirements, but has not succeed. On the other hand, some project perceived as successful though they have failed to meet the most important criteria. However, in a project environment, the project management can provide the achievement of project and organizational goals. In addition, project management presents a greater assurance to the stakeholders that all resources are utilized and managed effectively. â€Å"Projects fail at an alarming rate. Quantitative evaluations show that as many as 30% of projects are cancelled before completion, wasting all the time money and effort spent on them. Surviving projects usually fail to deliver the full initial project scope or deliver late or overrun the budget†. (William, 2002). Project management is very important when consequence is absence of proper project management or project management is not applied properly to the projects. Continues changes in project scope, the demand for efficient project management is emerged to maximize the resources. â€Å"Effective project management will help: meet or exceed customer expectations, maximize the use of your resources (time, people, money, space, etc.), bring the project to a successful conclusion on time and within budget, document what was done for any need of future reference, and build confidence in your team for future projects†. Government has imposed many rules and regulations on construction industries. This makes the construction projects more complex to do. Increasing amount of the competition in construction industries are now emphasis on the accuracy and the efficiency of work as well as the environment friendliness. So a proper management and well established plan is needed to face this situation. Conditions or restraints- under which organization/firm must work such as deliveries and deadlines. Resources may be fixed, variable or combined. When resources are used efficiently, they are said to be levelled. Planning is done independently of resources consideration. The assigning of resources to a plan determines the schedule automatically. Since duration estimates are only guesses, it is important that dynamic control be maintained. Float is a measure of available time verses required time. Jobs without float are said to be critical and lie on the critical path. There are four Kinds of float- Total float- differences required time and maximum time. Common Difficulties There are some common difficulties that are playing as a determiner of the success or failure of the project. Measurement problem Identifying and measuring the cost and benefits of a capital expenditure proposal tends to be difficult. This is more so when a capital expenditure has a bearing on some other activities of the firm (like cutting into the sales of some existing product) or has some intangible consequence (like improving the morale of workers). Usually 10-20 years for industrial projects and 20-50 years for infrastructural culture projects. Such a temporal spread creates some problems in estimating discount rates and establishing equivalence. (Chandra, 2007) 4. To evaluate the stages onto which the project management tools and techniques are applied while executing any construction project. It is very important to evaluate the tools and techniques that are used in a project to its successful conclusion. Every steps of a project is very important. The efficiency of the management depends upon the perfect use of its resources. One fault may change the overall condition of the project. 4.1. Their importance stems from three inter-related reasons- Long term effect The consequences of capital expenditure decisions extend far into the future. The scope of current manufacturing activities of a firm is governed targets by capital expenditures in the past. Irreversibility The market for used capital equipment in general is ill -organized. Further, for some types of capital equipment, custom made to specific requirements, the market may virtually be no existent. Once such an equipment is acquired, reversal of decision may mean scrapping be reversed without incurring a substantial loss. They are essential to estimate the importance of the project to the firm. According to Chandra, 2007 the factors are- Market analysis this factor determines the need of the project. That means how fruitful will be the project to the society. Technical analysis it determines the capability of the firm to complete the project. Financial analysis it determines the financial capability of the firm to complete the project as well as the profitability of the project. Economic analysis it determines the economic aspects of the project to the society. Ecological analysis it determines the biological aspects of the projects. Basically this is the most important factor to build built environment specifically in the construction industry.(Chandra, 2007) 4.3. Capital budgeting process Capital budgeting is the tool that ensures the outcome from the project and successful conclusion of the project. It is also very important to continue the regular activity and financing. It requires identifying all parties as well as stakeholders related to this project for proper execution of management of the project. First the plan of budgeting should be made than analyze it to determine the necessity and minimize the cost. After this firm should select the priority of financing and select the source of financing. Then implement it and review the effectiveness. The process can be shown as follows. The previous research reminds that the single project management is related with project portfolio level outcome. â€Å"A questionnaire survey with 279 firms verifies the hypothesized role of information availability, goal setting and systematic decision making in achieving portfolio management efficiency.†(Miia Pà ¤ivi, 2007, Pages 56-65) So, reaching project management goals and portfolio management efficiency are two different hypothesized links. Project management is known as a general issue, but most of the time so many of us get it wrong. Even if one gets it right once, the next time project is often so disappointment. The reason behind it may be unable to embed project management into all aspect of the organization and dont learn from the mistakes. In the built environment of construction industry the organization needs to consider which projects will delivery strategic objectives. Project management has emerged as a well-built discipline which is practiced by high level of training, certified experts as organizations have come to observe that they would not stay in business if they cannot handle their projects. However, many organizations are still limiting or reducing the application of project management to the tactical level. It is so much important for the organization to stay in the survival of the construction enterprises in built environment. 5.1 Role of Project Management Notably, the role of project management is defined especially by the following strategies:- Executive championship: high level of buy-in decision and the guidance to give support the portfolio manager. â€Å"Even organizations that have established a formal Project Management Office need an executive champion, particularly when the office is understaffed.† (Wessels, 2007) Business acumen: in order to meet the organization objectives, the project managers need to take quick decision about which projects are necessary. A solid project management process: leadership is an important tool to do the excellent job to create strategic portfolio in regarding project management of construction industry. the project managers and their teams should maintain and continue the practice of just-do-it. Timeframes and budgets: the budget and timeframes should be within the control of project so that the projects would not set up for failure from the beginning. It is known that construction industry is sixth largest industry in United Kingdom. So, it is needless to mention the importance of successful project planning and the budgets in a timeframe. The construction industry comprises a huge amount of investment and cost that is to be said unrecoverable. Hence, if the proper implementation does not occur especially in the UK built environment then there is the possibility of a large amount of loss. â€Å"According to the latest figures (April 2003) from the Office of Government Commerce statistics, 569 PFI contracts have been signed in the UK, 418 of which are already operational. The combined capital value of these contracts is  £53 billion, although the value of individual projects ranges from under  £1 million to over  £1 billion. In the construction and property sector, the scope of PFI has been wide-ranging, including roads, bridges, sewage treatment plants, waste incinerators, hospitals, schools, prisons and office accommodation. But despite the large number of projects procured to date, the effectiveness of PFI is still subject to considerable debate.† (emeraldinsight,2008) Requirements analysis: most of the cases it has been viewed that the organization does not follow and meet the proper requirements. This lack leads to a risky result for any type of organization. Stay the course: the benefit of project management is that it helps to stay in the course when the objectives and goals are determined. Whatever the task is, whether it is difficult or easy, staying in the course makes it possible to fulfill. 6. To identify the importance and need of project management with the augmentation of scope and complexity of construction project. It is strongly recommend that the benefit, challenge, objectives, goals, strategies all should be selected in a systematic manner for the better outcome. Furthermore, the stages of project management are to be considered and implemented in a normal procedure. The following diagram shows the stages involved in project management. The above figure suggests that at first the organization would focus on what would be their task and strategy that already mentioned. Then the next step would be to emphasize on how those task and strategy can be implemented. To implement successfully, the organization must have to consider the following criteria in accordance with their objectives: Adequate formulation: the project management helps to formulate the required data and information adequately and make the function more reliable. Sound project organization: sound project organization means how smoothly and efficiently the organization can run. When the proper project is implemented then the organizational activities become functional and easy to retain. Proper implementation planning: whatever the plan is should be implemented properly. The organization needs to follow the right way to make their plan of project effective and desired. It is strongly recommended that the right thing at right way would be implemented at right time and obviously at the right place. Advance action: advance action needs to take before going to consider about any project success. Good project management thinking helps to identify and recognize the advance actions those are needed to run in the built environment of construction industry. The success or final outcome of the effort depends mostly on the proper advance action. Timely available of funds: the project management plays a major role in regarding budget issue. The budget issue is equaled important for achieving the desired success. Barriers are involved when the project is maintained and run. Available of funds is one thing that formulates the process of a successful project outcome. Judicial equipment tendering and procurement: Better contract management: management is to be defined as planning, controlling, organizing and implementing the functional activities. Contract management is the field where all things related with the planning, controlling, organizing and implementing. The more managed contract, the more desired success can be gained. However, project management to success of construction is similar with blood to a body. â€Å"Communication on projects between owners and contractors can sometimes be difficult†. At every step, the organization has to face these challenges and only proper project management can make these challenge completed. Effective maintaining: the well maintenance of project is the heart of successful construction project. In the perspective of UK construction industry, effective maintaining can lead to a high level of success. â€Å"Project Management is not a catch phrase dreamed up by some marketing director. It is a well-developed body of science with its own processes, technologies, certified professionals, trade associations, and body of literature. So far, lawyers have not been a part of that world, but that is about to change†. (Donald,n.d) The importance and need of project management with the augmentation of scope and complexity of construction project cannot be ended in words. The development of project management within a construction industry related organization allows the management teams to work in partnership. Proficiency, locally, nationally or globally the implementation of project management bears some legal and ethical importance. The contribution of project management to a modern developed country like UK is a considerable topic. It is a formal methodology used to ensure that the projects would be completed on time and within the budget. However, project management is used historically in the construction industry, where methodology is firmly established. In the area of project management ability, making decision in a changing environment is the major concern. The rapid growth of project management is to be stated as an indication of a change in business function throughout all organization. It is implemented in construction industry to bring about change in organization platform so that they can lead change in organization. The trinity of project management is time, cost and quality (content or scope). All these things are the major objective function on a project. â€Å"The importance of effective project management is by no means restricted to new plant development and construction†. Discussion on Poverty in South Africa Discussion on Poverty and the current situation in South Africa South Africa has a population of 47.9 million people (http://www.southafrica.info/about/people/popprov.htm) the largest provincial province in South Africa is Kwa-Zulu Natal with 10 million people that is 20.9%. Gauteng is the most densely populated province in South Africa which consists of 9.6 million people. Gauteng is not the biggest province but because of the demand for work and income many people vacate their countries to find work in South Africa, people come from all over such as Botswana, Mozambique and most of all Zimbabwe. Many of these people come to Gauteng because of the working and living conditions in these countries are terrible and people cannot get jobs to afford to pay for their families. This does create and cause a lot of the poverty because not all foreigners can find the work and so then they have no way of leaving because they illegally live there, hence the Xenophobic attacks. Poverty in South Africa has lead to many problems in South Africa such as lack of skills, crime and education. Capital is what revolves around these socio-economic issues, because of the demand for capital people with a lack of skills cannot afford school and so they have no education. People have no money without a job and so they have to get capital, this is where stealing comes in and so the only way to obtain capital is to steal, this is why South Africas crime rate is so high because it is poverty stricken. South Africas population is dominated by Africans consisting of 78% in of the total population growing at 7% from 2001 to 2006. The remainder of the population is split as follows, Coloured 8% of the population growing at 5.77%, Indian 2% of the population growing at 4.18% and white 11% of the population growing at 0.43%. Listed on the JSE. As a large company Tiger Brands has to deal with many CSR related problems, one of their main focuses is poverty, because of their packaging they deal with a lot of food packaging. Tiger Brands have specifically looked at the feeding poverty stricken areas with many children in it. This is the starting point at helping the poverty in South Africa. Tiger has established a feeding and education program that has 17 township committees, 12 mothers clubs, 13 feeding centres and five mobile vans and a number of other methods that deliver food to the poverty stricken areas. I believe this helps poverty stricken people because obtaining food in an everyday struggle and so by addressing one of their main needs does help them a lot and also ables them to survive through the food provided by Tiger. This project is also sustainable because there is another short term program that is linked to the feeding which is an educational program that will ensure that the people in the area receive education that will allow them to be employed in the future and provide the country with valuable human capital, with the education and feeding programs Tiger Brands addresses 2 of the main corporate social issues, by addressing health they will be able maintain good levels of nutrition and so people will live healthy and so stealing should cut down because of a lesser demand of capital to purchase food, if other companies did this of course. Poverty in South Africa is too high, many major events will be held in the year of 2010 in South Africa such as the FIFA World Cup Soccer Tournament many people will be travelling from overseas to come and watch this prestigious event and so foreign capital will be coming to the country. Crime rates could affect this and so eradicating poverty could help by lowering the crime rate. If South Africa is seen as a stable place for investment after the world cup, the country can start to see new light with new infrastructure, more capital to aid problems in South Africa, so it is key to portray the country as one that is stable. One of the most common ways in obtaining these things is stealing. (Crime Chart Ref South Africa Survey 2004 Institute of Race Relations). Stealing is related to crime in South Africa and I believe crime is linked to poverty because people have no money to afford a house or food and so they have no way in obtaining basic needs and so they resort to stealing from people in cars, from peoples homes. I believe if we reduce poverty within South Africa we can solve crime because less pressure if found on people to support their families through illegal ways. Choice of company Discussion on choice of company My choice in companies was Tiger Brands, a local company that supplies with a wide variety food stuffs including basic nutrition such as bread, maize as well as canned foods. As Tiger are a local company and have a vested interest and social issues in South Africa their employment policy is directed at the local population because they have a true understanding of some of the problems that Tiger Brands faces. One of my main influences of choosing this company was because my father has dealt with Tiger Brands before and has background information on it, so information was viable. Tiger Brands have many advantages and disadvantages for their company which either help to enhance the performance of the company or bring it down, Tiger Brands works on all of their disadvantages because this brings down their name such as the price of bread going up and so they try to better their image after that incident through CSR projects and helping out the public. Unite 4 Health Following on from the success of Unite against Hunger, Tiger Brands healthcare company, Adock Ingram launched Unite 4 health in Jan 2006, aimed at supporting efforts to improve healthcare for disadvantaged South Africans. The Heart of Soweto study has initiated the important task of better understanding and monitoring of the emergence of heart disease in the Soweto population. Its significance lies in tracking the incidence of a disease often associated with increasingly affluent lifestyles in one of South Africas largest urban areas. South Africa is overwhelmed with starving children, mothers, fathers and people who have shacks for houses if not nothing for a shelter. These are key areas that need attention from the public to help re-enforce their infrastructure and living conditions. South Africa is a Third World country because of the high percentage of people living in no homes and people running short of capital to purchase food, this is why there is a lot of crime because people have no way of obtaining their primary needs such as food, water, electricity and so people resort to stealing. (Immediate needs living conditions) Hunger and poverty continue to be a reflection of the bigger socio-economic challenges that South Africa still faces. Most of our people do not have access to sufficient nutrition or basic healthcare. They the most comprehensive array of food and healthcare brands and products that play a huge role in the lives of our citizens. As a good corporate citizen, our objective is to find ways in which to give back to the communities and our country as a whole.25% of available funds to be used in rural huger and health initiatives. Poverty in South Africa can be seen almost everywhere. Every stop street, robot we see people begging because they have no money and they need food and need a shelter for their families. The Project I have chosen is the ACFS. Tiger Brands whole CSR project revolve around this one and it has many links with different CSR projects they have. This Project is called the African Childrens Feeding Scheme. African Childrens feeding Scheme (ACFS) For over 60 years, the ACFS Community Education and feeding project has made a difference n the lives of poverty stricken children by combating malnutrition through feeding and education. The ACFS has 17 township committees, 12 mothers clubs, 13 feeding centres, 5 mobile vans and 6 tricycles that deliver food. The focus is predominantly on children and the project feeds 18 000 children daily and 1 000 families each month. Many projects such as Earth Charter have been implemented in the world to enforce sustainability concerning natural resources, capital and human resources. Sustainability is about saving something for the future and then using it again in a natural resource case, in human resource raising a person in a business environment and teaching him the ways of your business is part of CSR and sustainability. St Stithians Boys College does do this with some of their staff, they do this by paying for his accommodation at the school, and the school pays for his studies. Once the employee has completed his work he will then in return work for the school e.g. Cricket Coach etc. Sustainability falls into two categories, Conservation and preservation of natural resources. (Geography for all grade 11 learners book) Sustainable Development- this is one of the ways that people are trying to balance human development with conserving the environment. Sustainable development is defined as ‘development that meets the needs of the present generation without undermining the ability of future generations to meet their own needs. This means that before we begin any new development, we need to make sure it will not prevent our childrens generation from meeting their needs. For example, when we cut down trees for wood, we need to make sure we leave tress to grow for future generations to use. Ideally we plant one new tree for each one we cut down. By helping out people in need of their main needs they can do this for their whole lives, as soon as they grow up they could join Tiger Brands and do what others did to them in the past. Through experience these people will know how and what to do and deal with because they were helped. South Africa has a very low literacy rate and many people are not educated this is a problem because this does cause poverty because people cannot get a job without an education and so an education is very important. South Africa has many unemployed people because of a lack of education. Tiger Brands has set up small schools and day care services to help the literacy rate. Private Schools are very expensive and so many children cannot afford to go to top schools. This is where you can find top quality education. Once education and hunger are being resolved people can start to prepare for other things in life such as saving capital for work and other things and then the unemployment rate should go down. Conclusion-All in all I think Tiger Brands main CSR Project is good and sustainable because people can come back and work for them. They have something good going on and they are making a difference in the community which CSR is all about and they are giving back to the community. Tiger Brands have addressed the serious problems in South Africa and have made a difference. South Africa has many problems that need to be solved in order to become a third world country which South Africa hopes to obtain and achieve.
